Marketplace- Terms & Conditions

1. Rozel Marketplace is organised by Rozel Breeding, located at Hawthorns Farm, Mortimers Lane, Upham.
2. Participation in this online breeders’ market means the explicit and unreserved acquaintance and acceptance of these terms and conditions of sale.
3. The Buyer must register via the website before he can place bids.
4. The horses/foals are sold in the condition they are in at the time of the videos.
5. Seller accepts the terms and conditions (5% of the sale price to be paid as commission when selling the horse via the website)
6. Buyer only pays for the horse/foal, with no additional purchase costs (except VAT – if applicable).
7. The Seller shall give the Bidder the opportunity to view foals offered for sale prior to a sale, if desired, only on request, by appointment with the Seller.
8. The sale is concluded in accordance with British law through acceptance of the offer by the Seller and after payment of the invoice amount.
9. Bids and payments are made in sterling.
10. Seller agrees that the desired price will place them into a price bracket, but buyers can make bids for any amount.
11. Buyer agrees to pay for the horse/foal if it is the highest bidder. It is not possible to withdraw a bid that has been placed.
12. Foals are listed for a period of 8 weeks and after this time are removed from the site.
13. An offer accepted by the Seller for a horse/foal results in a binding agreement. The buyer undertakes to complete the purchase. By placing a bid, the bidder undertakes to pay the invoice amount. The purchase price is calculated by increasing the sales price with any applicable VAT. If the horse / foal has been sold abroad, it must be provided with the appropriate export documents. The costs will be invoiced to the Buyer. The total will be the invoice amount.
14. The purchase price is due immediately upon assignment of the horse / foal. Once the Seller has accepted the offer, the Buyer will receive an invoice with the amount to be paid and the Seller’s details.
15. Any liability regarding the sold horses / foals will be transferred to the Buyer 5 days after acceptance of the offer.
16. At the time of payment of the invoice amount by the Buyer to the Seller, the ownership of the horses/foals is transferred to the Buyer.
17. After the total invoice amount has been transferred to the Seller’s account number, delivery will only take place, in consultation with the Seller. Transport costs are at the expense of the Buyer.
18. In principle, the delivery of a foal takes place after the foal has reached the age of 5 months. The Seller is obliged to leave a sold foal with its mother until the age of 5 months without the Buyer having to pay any compensation for this. Until the moment of actual delivery to the Buyer, the Foal remains at the expense and risk of the Seller.
19. When a foal younger than 5 months is delivered in consultation, the risk is transferred to the Buyer immediately upon delivery.
20. Foals should be in good health condition and halter trained at the time of delivery.
21. Neither the Seller nor the Buyer can derive any rights from the fact that Rozel Breeding has selected the horses / foals and that they have been subjected to a veterinary examination if desired.
22. The information given about the horses / foals offered for sale is only intended to give an impression about the qualities of the horses / foals without pretending to be complete and without wanting to give guarantees. Rozel Breeding is dependent on the information provided by a seller or third party when describing horses / foals on its website. Rozel Breeding is not liable for (printing) errors and/or mistakes on its website and in the online sales catalogue.
23. In case of export within the current year, the buyer will submit a valid export document, under penalty of charging the VAT due.
24. These terms are governed by and construed in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
